1. ACCEPTANCE OF TERMS

Welcome to City SC (“City SC,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website, programs, services, events, camps, teams, content, and related offerings (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

If you are using the Services on behalf of a minor, organization, team, or club, you represent that you have the authority to accept these Terms on their behalf.

2. ELIGIBILITY

The Services are intended for individuals who can legally enter into binding agreements or who are represented by a parent or legal guardian.

Participants under the age of 18 must have permission from a parent or guardian to use the Services or participate in City SC programs.

3. REGISTRATION AND ACCOUNT RESPONSIBILITIES

Certain Services may require registration or account creation.

You agree to:

  • Maintain and promptly update registration information
  • Keep login credentials confidential
  • Accept responsibility for all activities occurring under your account

City SC reserves the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

4. PROGRAM PARTICIPATION

Participation in City SC programs, camps, events, teams, clinics, tours, and related activities may be subject to additional registration requirements, waivers, eligibility standards, codes of conduct, and policies.

City SC reserves the right to:

  • Determine player placement and team assignments
  • Modify schedules, locations, coaches, and programming
  • Suspend or remove participants for misconduct, safety concerns, or policy violations
  • Cancel or modify programs due to weather, facility issues, insufficient enrollment, or circumstances beyond our control

Participation in athletic activities involves inherent risks. Participants and their parents or guardians assume all risks associated with participation, except where prohibited by law.

5. FEES, PAYMENTS, AND REFUNDS

Program fees, membership dues, event fees, travel costs, and other charges are subject to the terms disclosed during registration.

Payments may be processed through third-party providers.

Unless otherwise stated in a specific program agreement:

  • Fees are non-refundable
  • Missed sessions do not qualify for refunds or credits
  • City SC may establish separate refund policies for specific programs, camps, tournaments, or travel events

Failure to pay fees may result in suspension or termination of participation.

6. INTELLECTUAL PROPERTY

All content available through the Services, including but not limited to:

  • Logos
  • Trademarks
  • Team names
  • Graphics
  • Photographs
  • Videos
  • Written materials
  • Training resources
  • Website design and functionality

are owned by or licensed to City SC and are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, publish, display, or exploit any content without prior written permission from City SC.

7. USER CONTENT

You may submit information, photographs, comments, testimonials, or other content through the Services (“User Content”).

By submitting User Content, you grant City SC a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, display, and distribute such content in connection with operating, promoting, and improving the Services.

You represent that:

  • You own or have permission to provide the content
  • The content does not infringe any third-party rights
  • The content does not violate any law or regulation

City SC reserves the right to remove User Content at its discretion.

8. PHOTOGRAPHY AND MEDIA RELEASE

City SC may photograph, record, livestream, or otherwise capture participants during programs, events, competitions, camps, and activities.

By participating in the Services, you grant City SC permission to use photographs, video recordings, likenesses, names, and related media for:

  • Marketing and promotional purposes
  • Social media
  • Website content
  • Educational materials
  • Program communications

Parents or guardians may contact City SC regarding media concerns, subject to applicable program requirements.

9. PROHIBITED CONDUCT

You agree not to:

  • Violate any applicable laws or regulations
  • Interfere with the operation of the Services
  • Attempt unauthorized access to systems or accounts
  • Upload malicious software or harmful code
  • Harass, threaten, or abuse participants, coaches, staff, or users
  • Misrepresent your identity or affiliation
  • Use the Services for unlawful or unauthorized purposes

City SC may suspend or terminate access for violations of these Terms.

10. THIRD-PARTY SERVICES

The Services may contain links to or integrations with third-party websites, registration systems, payment providers, social media platforms, leagues, tournaments, and other services.

City SC does not control and is not responsible for the content, policies, or practices of third parties.

Your use of third-party services is governed by their respective terms and policies.

11. PRIVACY

Your use of the Services is also governed by the City SC Privacy Policy, which explains how personal information is collected, used, disclosed, and protected.

By using the Services, you consent to the practices described in the Privacy Policy.

12. DISCLAIMERS

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CITY SC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY.

CITY SC DOES NOT GUARANTEE THAT:

  • THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE
  • DEFECTS WILL BE CORRECTED
  • THE SERVICES OR SERVERS ARE FREE OF VIRUSES OR HARMFUL COMPONENTS

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CITY SC, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, COACHES, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO:

  • USE OF THE SERVICES
  • PARTICIPATION IN PROGRAMS OR EVENTS
  • LOSS OF DATA
  • BUSINESS INTERRUPTION
  • PERSONAL INJURY
  • UNAUTHORIZED ACCESS TO INFORMATION

IN NO EVENT SHALL CITY SC’S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY THE USER TO CITY SC DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless City SC and its affiliates, officers, directors, employees, coaches, volunteers, and agents from any claims, liabilities, damages, losses, and expenses arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of another person or entity

15. TERMINATION

City SC may suspend, restrict, or terminate access to the Services at any time and for any reason, including violations of these Terms.

Termination does not affect any rights or obligations accrued prior to termination.

16. GOVERNING LAW

These Terms shall be governed by and construed under the laws of the State of California, without regard to conflict-of-law principles.

Any dispute arising from or relating to these Terms shall be brought exclusively in the state or federal courts located in San Diego County, California, and the parties consent to the jurisdiction of those courts.

17. CHANGES TO THESE TERMS

City SC may modify these Terms from time to time.

Updated Terms will be posted on the website with a revised “Last Updated” date. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
